the house came from a neighbor across the street who called 911. within five minutes, firefighters were in front of the house where they found an adult female and an 8-year-old girl outside and both conscious but suffering from smoke inhaling a. >> and one firefighter received second-degree burns from the search. the hardest part is pulling the kids out of the house. >> reporter: the fire claimed the lives of a 36-year-old man and his 8- and four-year-old daughters. the fire began on the first floor of the house, which is not, quipped with smoke alarms. >> that fact is sad for me and frustrating. >> reporter: neighbors say the family lived in the one-story house for two years and a large garage in the rear holds a auto shop. >> it's tough. our kids play together every

day. in the school and every weekend. >> reporter: somehow, the girl's mother and eight-year- old daughter escaped out of a window. the firefighters found them in the yard when they arrived. by midday, firefighters were going door-to-door on leslie avenue checking smoke alarms and installing new ones if needed. now, although neighbors have told us the names of the young children who were killed, the survivors and the family who lied here, we're withholding that information right now because the fire department has not released that information. what i can tell you is that of the three survivors, the 33- year-old mother and her eight- year-old daughter are hospitalized at this hour, suffering from smoke inhalation and there is an 11-year-old who is reported to be in grave condition at this hour. again, this is reported to be accidental and, although the alcohol, tobacco, and firearms investigators have been here,

it's not believed to be suspicious at this hour. shawn. >> such a tragedy. wall packer in, thank you. -- paul wagner, thank you. new at 5, a montgomery county teacher is under arrest charged with sexually abusing two of the female students. the victims told police that he touched them inappropriately on several occasions between september of 2012 and this february. the alleged incidents happened at meadow hall elementary school in rockdale where he teaches the fifth grade. dozens of former patients contacted a lawyer after a gynecologist was exposed for taking secret videos of the patients. the doctor killed himself a few days agoas john's hopkins investigated and he plans to sue him over the behavior claiming the hospital supervision was lacking in this case. a popular swim coach who trained swimmers plead guilty to child sex abuse and is new

banned from coaching for life. john henrehan has more. >> reporter: the female swimmer was young and she was 13 when her coach began touching her inappropriately. they turned into a full-blown sexual relationship. the coach is facing a 15-year prison sentence. 63-year-old rick curl, who built one of the biggest swim instruction programs in metropolitan washington, has pleaded guilty to child sex abuse. his victim is now 43 years old, but she was barely a teenager when her swim coach started fondling her and eventually established a five-year sexual relationship with the girl in the 1980s. >> and this had a lifelong impact on her. it doesn't go away. when you're in your formative years and people talk about you being voluntary, volunteer when you're 14, 15, you're not in a voluntary relationship with someone 20 years your senior.

>> reporter: according to a police document, the coach had sex with the teenage girl at the georgetown prep school and in in various homes and when asked by a judge if he's guilty, curl in a quiet and firm voice answered yes, yes, you're honor. the victim's eyes occasionally misted up during the proceedings. the news agencies usually shield the identity but she gave the media permission to use her name and image. in the courtroom, he never looked at his former student and is facing up to 15 years in prison when sentenced on may 23rd. until then, he remains free on a $50,000 bond. asked if authorities believed there could be other victims, the prosecutor said there is currently no active investigation. shawn? >> thank you.

a news alert out of virginia where a man was murdered while walking his dog. he was walking the dog last night when someone shot and robbed him. an offduty police officer helped catch the suspected gunman moments later. audrey barnes is live with our story. audrey. >> reporter: this woodbridge neighborhood is in shock tonight after the shooting death of a retired agent from the alcohol bureau and firearms bureau, the atf. the 55-year-old greg holly senior was walking his dog at 9:40 last night. a suspect shot him to death and then robbed him, ran away with his property. and an offduty prince william county sheriff's deputy spotted the man and, after a brief struggle, he was taken into custody. the people who live along worth drive are, obviously, worried about their safety after such a senseless act of violence. >> i think it's a rarity.

for the most part, for us to have the one murder and longer than i can remember and i won't say the special too concerned but this is unusual. luckily the suspect was apprehended quickly and is? in jail. >> reporter: the 25-year-old eric alexander smith of woodbridge is in custody and being held without bond and is facing first-degree murder charges. police say that they did recover some of his property on the suspect after he was chased down by the officer and they recovered the murder weapon. it was stolen from a vehicle in mount clare just last week and back to you in the studio. >> audrey barnes, thank you. a developing story in south africa. a murder case against the olympic gold medalist. the lead investigator in the oscar pistorius case is facing

attempted murder charges. he and two other officers are under investigation for a shooting into a van back in 2011. the police named a new detective to head the pistorius investigation now. developing now, the dramatic deaths on the vegas strip this morning. investigators say that it may have started with a fight at a hotel. three people died, at least six were hurt when someone in an suv opened fire on the maserati. the driver was killed sending that car into a taxi which burst into flames. the cab driver, the passenger died and a passenger in the maserati was hurt. >> i ran over there to help the dude in the mazer aughty and pulled him up. and tried to give him cpr and he was breathing at that time. >> a black range rover took off from the 61. investigators in three neighboring states are looking for the suv. winter weather is pounding the midwest since overnight. this is kansas city, missouri.

parts of the region are expecting a foot and a half of snow before it's over. folks in kansas recall told to stay off interstate -- kansas were told to stay off interstate 70 entirely. gary, sounds like a real mess there. >> reporter: that is a big time mess and you saw that. not only are the snow totals up over a foot approaching an inches in some places, the wind is really blowing and tacking about a potential for blizzards out there. the wind blowing 35 miles an hour and more. you have a lot of though and big time thunderstorms to the deep south and that is some severe weather. the snow is mixing now to some ice and some sleet mixing in with that and this is coming in our direction and let me just let you know that as it gets closer to us, the storm is going to break into pieces. part of it is going to go north and part south. yes, we're expecting a little snow and sleet.

a washing tonight if you enjoy seafood and sushi. you may not be getting what you pay for when you eat out or at the grocery store. a new study found as much as one/3 of sea food is labeled incorrectly. dr. kimberly warner is the lead author of the study. good to you have here. >> thank you for having me. >> and that is not just mislabeling, we're talking about. according to your study, it's widespread fraud. >> yes, the mislabeling we're talking about in this study is sea food substitution, swapping out one type of fish for the other and in these substitutes,

they cheaper, farm fish being sold as wild cod fish. >> more than 30% were mislabeled. like what? >> the top fish mislabeled were anything with snap in the label and things labeled white tuna. 87% of what we bought was not snapper and 85% of the white tuna was escalar, snake mackerel feces that can cause severe gastrointestinal effects for people who eat too much. >> this stuck out. it's 85% of the white tuna sample is not tuna? what about the health issues for, say, pregnant women trying to avoid high mercury content? >> unfortunately, when we found the high mercury fish in our study, the king mackerel and kyle fish were being sold as red snapper, halibut and

grouper. and so, they were not frequent substitutions but, you know, a few of them and that is disturbing for people who are trying to choose their fish carefully for health and conservation concern. >> what about sushi venues in same deal as retail outlets? >> yes and we sampled sushi venues, restaurants and grocery stores across the country. sushi venues were the -- had the highest levels of mislabeling, over 70% nationwide, over 80% in the nation's capitol. and whereas grocery stores were in the middle with 38% nationwide, 48% in the district. and grocery stores had the least amount of mislabeling. >> and fair to say, doctor, the fault doesn't la jolla with the retail stores and some sushi restaurants because they don't have labs to check. i am sure you would agree, giant, safeway, these stores are not trying to sell customers the wrong thing. >> yes, unfortunately, the study couldn't identify where the fraud was occurring and we

have a complex sea food supply chain that is not transparent and this mislabeling could have happened anywhere along the line and that is why we're trying to get a good traceability on our -- from our fish from boat to plate to identify where the fraud is occurring and the name of the fish and where it was caught. we'll follow you from the boat to the plate. >> as consumers what, can we do? >> talk to the people that sell you sea food at the grocery store, at the restaurants, at the sushi venues. tell them that you're good is what kind of fish you're being served, how it was caught. and all sorts of things. they may want to provide more envelope allegation if you show you are interested. >> and of the last question in my mind, if you're in the business of selling tuna, 85% is not tuna, won't you know

that that is not tuna but another fish? >> one would think. this is specifically for white tuna and for other tuneas, it was 10% of the other types of tuna and this is -- and it's likely sold in sushi venues. >> fair enough. kimberly warner, thank you for sharing the results of your study with us, doctor. >> thank you for having me. a grand jury indictmented four companies linked to a deadly salmonella outbreak in 2009. nine people died and several others got sick. the owner along with the company's vice president and two plant managers, are facing charges related to contaminated or misbranded food and they're also charged with conspiracy, wire fraud, and obstruction of justice. and a health alert of the flu vaccine. this year's version is 9% effective in protectioning seniors against the most common

and dangerous strain of the bug. for all age groups, the vaccine's affectiveness was a moderate 56% and experts say the results are disappointing. it appears americans are eating less fast food. according to a new survey by the cdc, fast food accounted for 11% of the calories in the adult's daily diet. researchers say the number is not great, it's better than a 13% from 2003-2006. and children are consuming, it turns out, fewer calories each day than a year ago. the cdc said between 19 inspect and 2010, the -- 1999, and 2010, the boy's daily calorie consumption fell and girls intake dropd about 80 calories. it's a step in the right direction in fighting the childhood obesity epidemic. it's the third anniversary of first lady michelle obama's campaign to end childhood obesity. this year, the let's move

a special d.c. council meeting will be held next week to discuss pushing council member jim graham by stripping away some of his power. it stems from an ethics violation that was investigated by the newly formed ethics board. the board didn't have the power to punish graham, so it appears the council could pick up, rather, where it left off. matt ackland is here now to explain how graham is fighting back in court. matt? >> reporter: jim graham will go before a judge tomorrow in an effort to block the findings of the ethics board. he believes that he never had a chance to give his side. but at the same time, council chairman phil mendelson is proposing punishment for graham that will be embarrassing and take power away. council member jim graham was at work thursday, leaving the

hearing that has oversight of how alcoholic beverages are regulated in the district. it's this leadership role the colleagues could take away from him. >> his conduct harmed adversely, adversely harmed the public's confidence in and the integrity of the district government -- and the integrity of the district government. >> reporter: graham broke the city's code of conduct three times when it came to a deal when it has to do with the district's lottery contract and a development deal connected to metro. >> we're seeking an injunction. >> reporter: graham's not going down without a fight and sent his lawyers to court. >> their findings were yawn the legal reach of a hearing and we welcome the opportunity. >> reporter: the chairman is privately meeting with other council members about the reprimand for graham and he will likely have support on

monday from many members. >> i'm going to fight as hard as i can and to get them there. >> reporter: as he briefed reporters outside of the office, gralast minute was listening steps away. he hopes instead of pushing him, council members will call for a hearing to investigate instead. >> and this can be solved if five members of this council requested a special committee be convened to conduct a hearing. >> reporter: chairman mendelson doesn't want a hearing. he would rather vote on this reprimand on monday and move on with the city's business. by the way, it doesn't appear that graham is too concerned about this right now and he would not confirm if he planned to run for re-election. he said if it was, he would win j. he's confident. >> uh-huh. >> a maryland man who has been

held in a cuban prison for years in 2009, accused of undermining the cuban government. tom fitzgerald spoke with congressman chris van holland who got back from visiting gross in cuba. how is he doing? >> reporter: as you might expect, the congressman told us that allen gross is understandably very frustrated about this continued detention at the hands of cuban authorities and even more show, because his mother is apparently a sick and -- is sick and he would like to get out of the jail to see her. he's from potomac, maryland, he was arrested several years ago while distributing internet computer equipment during a sanctioned visit and program proved by the u.s. agency for international development. the congressman in vermont, senator patrick leahy met with allen gross on tuesday in detention as well as with cuban president castro. and he tells us the united states is eager to have gross free and he is eager to be

released. >> well, he is not surprisingly very frustrated about his continued detention. he's very thin, lost a lot of weight. he's showing beyond his belt the additional holes he would have to punch to make sure he had a belt to hold his pants up. he was very energetic about the need to resolve the situation and get him out. >> you may wonder if he did nothing wrong, why is he being held in this jail? the congressman said cuba is seeking the release of five cuban nationals being detained here in the united states and in a separate case. during his meeting with raul castro, he reiterated the united states's position that allen cross should be released with no preconditions because the united states condition, shawn, is that he did nothing

wrong. >> tom, thank you. the army reversed a promotion given to the mistress of the former director of the cia, david petraeus. paula broadwell was promoted to lieutenant colonel in the army reserves last august and that is reversed, pending an investigation. investigators believe that she may have classified information in her home without permission. under army rules, a promotion can be delayed if now information comes to light within six months. american drones killed 4700 people and the republican supports the program. he made the comments at a rotary club meeting in his home state earlier this week. the 4700 figure is higher than other estimates and that is by groups less supportive of the program. he claims the numbers are based on media reports and not u.s. intelligence. the tsa is forced to apologize after this disturbing video surfaces online. >> and, are you worried about

. the tsa apologized to a missouri family after agents insisted on patting down a three-year-old wheelchair bound girl. the mother shot at the security checkpoint in st. louis. >> and you can't touch my daughter. -- . >> and the mother said two separate agent his to pat down the daughter. the agent said it was not necessary. they accept the apology but want screeners to be better trained. investigators are trying to figure out why a small jet overshot the runway and crashed killing five people. the crash happened last night in thompson, georgia. a pilot and passenger survived but were hurt and the plane was traveling from nashville. >> would you book a cruise in the wake of the recent carnivale cruise incident? i'm phil keating in miami. why some are saying now is the

. you might be thinking twice about your travel plans after last week's cruise ship disaster that stranded thousands of people at sea. experts say that now is the prime time to book your travel. phil keating has the story. >> we had the pop in the bag. >> reporter: it was a nightmare at sea. >> the terrible odor. >> that is when it became a floating petrie dish. >> try to live in there for three minutes and breath. >> reporter: a cruise ship virtually paralyzeed after an onboard fire knocked out everything from power to plumbing. passengers say it turnd into a filthy ship of squalor and many of them say they will never

sail again. >> never again in my life will i walk around a cruiseship. i'm -- cruise ship. i'm done. i'm done. never again. it's not going to happen. >> reporter: the latest incident could be a setback for cruise companies. >> in terms of carnival, i think they will have a little bit of repolishing of their brand required after they get that ship back in the ocean. >> reporter: some travel experts, however, say now might be the time to book a trip. >> yeah, this is the time when all of a sudden, the cruise deals will become perhaps a bit more prevalent and increasingly more attractive. >> reporter: the same thing happened after last year's sinking of the costa concordia and owned and operated by carnival. they saw bookings nose dive. the deals were there and savvy sailors took advantage. >> with that incident, we saw aggressive sales within the next few months and that is some aggressive package sales and travel incentives.

>> reporter: the deals don't just pertain to the cruise industry. rewind to '09. the swine flu outbreak in mexico had a crushing affect on resort cities from cabo san lucas to cozumel. according to the united nations world tourism organization, the number of foreigners visiting mexico plummeted more than 11% in large part because of hidden hidden. in -- h1n1n. can counsel alone, hotel vacancies -- in 2009, hotel vacancies fell. others slashed rates and offered other incentives to lure back beachgoers. >> the vacation companies take the lead on that. by bundling travel, you get aggressive savings passed on to the consumer. hotels on the ground and airlines jump in pretty a guessively as well. >> reporter: health issues are a serious concern on any vacation and it's wise to do research first. a good first stop is the centers for disease control

website. also a good idea buying insurance to cover unexpected costs that materialize. phil keating, fox news, miami. >> with the cold weather coming our way, we may want to take a trip somewhere warm. >> that sounds good about now. >> and slow going somewhere will be nice. i want to say this, too. it looks like the extended period one, two, maybe three weeks can and we're not, i don't so any mild weather coming our way, and actually, we can stay where we should be or below that. >> oh. okay. >> and book that cruise, right? [ laughter ] >> is this good for the travel industry? is this forecast going to help the cruise industry? i don't know. listen, coming up in the acwith you either accuweather forecast, we have a good storm system to the west&of us and starting with the -- west of us and temperatures 39 degrees now. the wind is blowing cooler to the north and west. the wind gusts still at 25 miles an hour and as we progress through the evening

hours, the wind is going to come down. i still think it's probably going to be a little on the breezy side even by 9, maybe 10:00. overnight tonight, the winds will die off quite a bit. the windchill feels like 31 now in town. twentys for just about everybody else and not as bad as it was last night. still, if you step out there, it could be uncomfortable, especially with the sun going down the next 10, 15 minutes or so. we'll get good and dark, the temperatures are topping and going to be cold. again, even some on the breezy side by 9:00. colder in the suburbs by 11 and to 30 in town. it will drop easily down into the 20s tonight. all eyes on this big storm out to the west of us. they have had some blizzard- type conditions through the central plains here. the snow is transitioning from st. louis where it's becoming a messy mix and into that storm down south, the severe weather this evening. it's almost like a big spring- like storm. you get the snow and the severe weather on the southern side of

it and we're still clear now. the clouds will start coming in overnight tonight and that will keep the temperatures steady. they're going to be below freezing by tomorrow morning. and future cast will show you that this is 8:00. the way it's looking now, the majority of the morning commute you should be in pretty good shape. sometimes they can come in faster and we get a piece of energy coming across earlier. but i think that we're pretty good for the morning commute. okay. and look at this. just some snow showers back out along i-81 and early as 8:00. we're still dry here in the metro. as we progress through the day, we're going to have some snow, some sleet, and that is going to continue in through the day and periods of that passing along, not everybody is going to be snowy and sleeting all day. by no means. most of the moisture is going to stay to the south of us. the big storm out west is go splitting into two parts. say lot of it is going to stay to the south and a lot to the

north of us. again, the evening commute, i think, could be compromised and with is some? and sleet and will begin tomorrow, 5, 6, 7 in the evening to start the transition as the atmosphere above us begins to go through a warming state. and as that happens, it can become a wintery mix. a little bit of everything and we don't expect a lot of accumulation here and by 10, 11:00 tomorrow night, most of this is moving along. in terms of how much we may get in terms of the snow and the sleet, before it begins to switch over to all rain. again, not a lot and we're thinking some light accumulation and i really think it's going to be hard to narrow this down. some of you won't get anything. others of you will get a coating of sleet on the ground and grass and a coating of snow as l. of course, a little more farther to the north and west and we're showing one to three inches in the higher elevations, pardon me, that is going to be west of i-81 for

this is just in. a judge sentenced drew peterson for 38 years in prison for murdering his third wife. the jury convicted him for the 2004 death of cathleen savio.

he's suspected in the 2007 disappearance of his fourth wife, stacy peterson. mer disappearance is what led authorities to relook at savio's death and rechafe it from a suicide -- reclassify it from a suicide to a homicide. and last month, the trial judge rejected arguments that defense attorneys did not have enough time to prepare for the trial. sandusky was convicted last year on 45 counts of child sex abuse. new york jets quarterback tim tebow backed out of an appearance at a mega church in texas, led a -- lead by a controversial pastor. he's canceling the april 28th appearance at first baptist church in dallas. the church's leader, reverend jeffris, preached that gay people are sinners and spoke out against muslims, mormons, and jews. he called him last night and said he needed to avoid controversy right now for personal and professional
